The Pactum Factum podcast "Forces of Good: The Superpower of Everyday Negotiation" is designed for everyone to build their everyday negotiation muscles. We have practiced in the private sector (for large fortune 100 companies and boutique sole proprietorships), public sector, non-profit sector, and have taught and trained in both the academic and corporate environments in the U.S. and abroad. We have particularized training and keen ability to listen to the circumstances and interests of each unique situation and to tailor our approach accordingly. A prospective mediation client of Pactum Factum is advised not to hold preconceived notions of what our conflict resolution style and process might look like. For example, people ask us, "Are you facilitative or evaluative?" Our answer is: "Neither. And both. It depends on what time of day it is and what the parties need." Many attorneys who accompany parties to mediation expect the mediation to conform to a certain process and our process may or may not conform to such standardized expectations.We do not track our "wins." "Winning" does not necessarily mean settling cases; "winning" somehow implies that our ego is invested in the outcome. Mediators who track the number of cases they have settled, we believe, could risk compromising their neutrality. Our techniques track cutting edge psychological dynamics of behavioral economics, choice theory, negotiation and dispute resolution, including correlating negotiation styles with success, collaborative research on emotion, micro-expression and lie detection, and integration of neuroscience and decision analysis into every stage of a negotiation and mediation.
